By agreeing to these T&Cs, you are committing not only yourself but also anyone associated with your account, any authorized users, and anyone you permit to use the Services, Product, or Device, to these terms.

You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to Svzto Mobile, or its service provider for the duration of your business relationship, solely to help them identify you or your wireless device and to prevent fraud. This Privacy Notice outlines what information we gather, how we might use and share that information, and the choices you have concerning certain uses of your information.

 

Overview of the stipulations in this agreement

With whom is this contract established?

These T&Cs are an agreement between you on behalf of yourself, your Authorized Users, any person on your account, and any person you allow to use the Services, Product or your Device, and us, Svzto Mobile, Inc., and our controlled subsidiaries, assignees, and agents (“us”, “we”, “our” or “Svzto Mobile” , “Callzy Mobile“, “Svzto Mobile”).

What is the process for agreeing to these Terms and Conditions?

You agree to these Terms and Conditions by any of the following actions:

  1. Providing a written or electronic signature, or verbally confirming your acceptance;

  2. Activating, utilizing, or making a payment for the Service or a Device;

  3. Refrain from engaging in these activities if you do not wish to agree to these Terms and Conditions.

By accepting, you verify that you are legally competent, meaning you are either legally emancipated or have reached the age of majority as per your jurisdiction's laws, and are capable of forming a legally binding contract. If you are accepting on behalf of an organization, you confirm that you have the authority to legally commit the organization. In this context, "you" may refer to the organization itself.

What does this agreement encompass?

In these T&Cs, you'll find important information about:

  1. Our services provided to you (“Service”); 

  2. Any equipment for which we provide Service or which we provide to you to be used with our Service, like a phone, handset, tablet, SIM card, or accessory (collectively, a “Device”);

  3. Any feature, product, or solution that we provide to you, (collectively, a “Product” or “Feature”);

  4. Any charges, taxes, fees, and other amounts we charge you or that were accepted or processed through your Device (“Charges");

  5. Network management practices;

  6. Limitations of liability; and

  7. Resolution of disputes by individual arbitration and class action and jury trial waivers.

Do any additional conditions apply to me?

Yes. Your "Agreement" encompasses these Terms and Conditions (T&Cs), along with the supplementary terms outlined in your Rate Plan and/or Data Plan, your Service Agreement, our business policies and practices as published on the web and/or provided to you (and subject to amendment by us), terms and conditions pertaining to any additional Product(s) you select, and provisions linked to from these T&Cs. Sections marked with an asterisk (*) remain in effect even after termination of our Agreement with you.

Additionally, it's important to note that our Privacy Notice, accessible at http://svzto.com/privacy, applies to the utilization of our Devices, Products, and Services.

How long do these Terms and Conditions last?

As the Prepaid MVNO Carrier, we've eliminated annual service contracts. You have the freedom to leave, although we would be saddened by your departure. If you decide to transfer your number to another carrier, your Service will be deactivated immediately once the number is successfully ported. However, you will still be charged for the full billing cycle. Additionally, cancellation may affect other services billed through us, as well as any subscriptions you may have with us.

What methods will we use to communicate with one another?

You can reach us at http://svzto.com/, by dialing 1-212-680-0112 or 611 from your Device, or by sending mail to: svzto Mobile Customer Relations, 275 Grand Street, New York, NY 10002. Notices may be delivered to you via mail, phone, or electronic means using the account information we have on file. Electronic notices are considered delivered upon transmission, while mail notices are deemed delivered three days after mailing. For multi-line accounts, we may designate a "Primary Telephone Number" for receiving notices and other purposes. If you wish to change this number, please contact us.

For initiating arbitration or any legal proceedings, you must serve our registered agent. Our registered agent is Corporation Service Company, and they can be reached at 1-866-403-5272.

Is svzto Mobile authorized to modify, pause, or end my services or this contract?

Yes. With the exception of Rate Plans featuring the price-lock guarantee, we reserve the right to modify, restrict, suspend, or terminate your Service or this Agreement at any juncture, including instances where you engage in any of the prohibited activities delineated in these Terms and Conditions, relocate outside of a svzto Mobile owned/operated network coverage area, or exhibit harassing, threatening, abusive, or offensive behavior. In the event that your Service, Product, or account is curtailed, suspended, or terminated and subsequently reinstated, you may incur a reconnection fee. Please note that your account may continue to accrue charges even during periods of Service suspension, and you are liable for any fees incurred while your Service or account remains suspended.

We may block your Device from operating on our network under certain conditions. Should we plan changes to your Service, Product, or Rate Plan that could significantly affect you, we'll provide a 14-day notice before implementing the changes. By continuing to use your Service or Product after these changes take effect, you are implicitly agreeing to them. We also reserve the right to block specific types of calls, messages, or data sessions (including but not limited to conference and chat lines, broadcast messages, international calls, and calls to 900 or 976 numbers) without additional notice.

For those subscribed to a Rate Plan with a price-lock guarantee, we commit to not increasing your monthly Recurring Charge for the time your Rate Plan specifies, or indefinitely, provided you remain in good standing on an eligible Rate Plan. Should you change plans, any price-lock guarantee on your new Rate Plan will apply. It's important to understand that the price-lock guarantee only covers your Recurring Charge and does not include other fees such as for add-on features, taxes, surcharges, or charges for additional Features or Devices.

Am I agreeing to be reached out to?

Indeed, we hold the privilege to reach out to you at no cost on any wireless number linked to your account for a variety of reasons, including marketing purposes, and through any means lawfully allowed. By agreeing to these terms, you explicitly permit svzto Mobile and our representatives to contact you for any cause, including those related to billing and collections, at any postal address, phone number, or electronic address provided by you. You understand and consent to the possibility of svzto Mobile or our agents using automated means, such as pre-recorded messages or automatic dialing systems, for communication. Moreover, you commit to informing us without delay if you cease to use a previously provided contact number. You affirm that consent has been obtained from all Authorized Users and others on your account for contact by us as described herein. Furthermore, you recognize that all consents given in this section persist even if your Service or account is subsequently cancelled.

How can I settle disagreements with Svzto Mobile?

When you accept these Terms and Conditions, you consent to settling any conflicts with us via individual binding arbitration or through small claims court, provided you don't opt out. This agreement means you relinquish your right to a jury trial and the option to join in class action litigation.

Individualized Dispute Resolution and Arbitration. Both you and we agree that, except as outlined below, any and all claims or disputes, regardless of their nature, including tort and statutory claims, pertaining to or regarding the Agreement, our Privacy Notice, privacy or data security practices, our services, devices, or products, including any billing disputes, will be resolved through individual binding arbitration or in small claims court. Arbitration proceedings do not involve a judge or jury, and court review of an arbitration award is restricted. The arbitrator is bound to adhere to this Agreement and can award, on an individual basis, the same damages and relief as a court, including attorneys’ fees.

This encompasses any claims against other parties concerning services, products, or devices provided or billed to you (such as our suppliers, dealers, authorized retailers, or third-party vendors) whenever you also assert claims against us in the same proceeding. Both parties acknowledge that the Agreement impacts interstate commerce, thus subjecting the Federal Arbitration Act and federal arbitration law to govern the enforceability of this dispute resolution provision, notwithstanding any general choice of law provision outlined below.

However, you have the option to choose to pursue your claim in court and not through arbitration if you opt out of these arbitration procedures within 30 days from the earlier of the date you purchased a product or device from us or the date you activated a new line of service (the “Opt Out Deadline”). It is essential to opt out by the Opt Out Deadline for each line of service. You can opt out of these arbitration procedures by calling 1-212-680-0112 Any opt-out received after the Opt Out Deadline will not be valid, and you will be required to pursue your claim in arbitration or small claims court.

For any disputes or claims you wish to raise, you must initially provide us with an opportunity to address your concerns by sending a written description of your claim (referred to as a "Notice of Dispute") to the address specified in the “How Do We Notify Each Other” section. The Notice of Dispute must include sufficient information for us to identify your account and attempt to resolve the claim, including: (a) the name of the svzto Mobile account holder; (b) billing account number; (c) the mobile telephone number associated with the issue; (d) a written description of the problem, relevant documents, and supporting information; and (e) a good faith calculation of the damages you claim to have incurred, along with a statement detailing the specific relief you are seeking. You have the option to be represented by an attorney or another individual during this process. However, if you opt for representation, you must also provide a signed written authorization permitting us to discuss your account with your attorney or representative.

Similarly, if we have any dispute with you, we will send a Notice of Dispute to your billing address. Both parties agree to engage in negotiations in good faith to resolve any claims between us. Neither party may initiate arbitration or court proceedings unless we are unable to resolve the claim(s) within 60 days of receiving the Notice of Dispute, during which time both parties must make genuine efforts to address the claim.

Should we be unable to settle any disputes within 60 days despite sincere efforts, either party — you or we — may proceed to initiate arbitration or file a claim in small claims court. To begin arbitration, you are required to send a written request for arbitration, which includes details of your claim, to our registered agent (as specified in the "How Do We Notify Each Other" section below) and to the Better Business Bureau® (“BBB”). The arbitration will be governed by the BBB's Consumer Arbitration Rules in effect at the start of the arbitration, unless these rules are in conflict with our Terms and Conditions. In case of conflict, our Terms and Conditions take precedence. You can review the BBB rules at www.bbb.org. If the issues raised in the arbitration could have been pursued in small claims court, either party has the option to move the dispute to small claims court instead of arbitration. This choice can be made at any point before an arbitrator is appointed by notifying the other party in writing. Any debate over the suitability of a claim for small claims court will be determined by the court itself, not by an arbitrator. If the case moves to small claims court, the arbitration will be paused until the small claims court decides whether the claim should return to arbitration.

Class and Mass Action Waiver. Both parties, you and we, recognize and consent that any legal proceedings, whether conducted through arbitration or in court, will proceed strictly on an individual basis, excluding any form of class, representative, mass, or consolidated actions. If you decide to opt out of the arbitration agreement as outlined previously, this specific waiver regarding class actions will not apply to you. Without fulfilling the opt-out conditions mentioned earlier, neither you nor any other customer may serve as a class representative, be part of a class, or engage in any class, consolidated, mass, or representative proceedings.

Should a court or arbitrator find any part of this arbitration provision or the Class and Mass Action Waiver unenforceable for a specific claim, remedy, or request for relief, then said provision and waiver will not apply to that particular claim, remedy, or request for relief. Nonetheless, the arbitration provision and Class and Mass Action Waiver will continue to govern all other claims, remedies, and requests for relief brought forth by either you or us in that or any other proceeding. In these cases, both parties agree to first arbitrate all claims, remedies, and requests for relief on an individual basis. Only if issues remain unresolved after the arbitrator's decision can they be pursued in court. It is also agreed that the court will not be bound by or owe any deference to the factual findings made by the arbitrator in such subsequent court proceedings.

Jury Trial Waiver. Should any claim be resolved in court instead of arbitration, BOTH YOU AND WE EXPRESSLY RENOUNCE ANY RIGHT TO A TRIAL BY JURY.

WHAT LAW APPLIES TO THESE T&Cs?

This Agreement is subject to the Federal Arbitration Act, relevant federal laws, and the laws of the state or jurisdiction where your billing address in our records is located, without consideration for the conflicts of laws principles of that state or jurisdiction. Foreign laws are not applicable. Arbitration or court proceedings must take place in the county and state or jurisdiction where your billing address in our records is located, and cannot occur outside the U.S. or Puerto Rico.

ARE THERE ANY WARRANTIES?

In general, no warranties are provided, except for any written warranty accompanying a Device purchased from us, and to the extent permitted by law. The Services, Products, and Devices are offered on an "as is" and "with all faults" basis, without any warranties, express or implied. We do not make any representations or warranties, including any implied warranties of merchantability or fitness for a particular purpose, including security or authentication purposes, regarding your Service or Device. While we endeavor to safeguard customer accounts, we do not guarantee security. If you choose to use your Service or Product for security or authentication purposes for other accounts, you assume responsibility. We cannot guarantee uninterrupted or error-free Service, and we do not authorize anyone to make warranties on our behalf. This does not waive any warranty rights you may have against others. We do not ensure the privacy or security of your communications; while it is illegal for unauthorized individuals to intercept your communications, such interceptions can still occur.

The services offered by svztoMobile are accessible only within the operational coverage of its network, which may vary over time. You, as the customer, recognize that various factors, including but not limited to physical barriers, weather conditions, the devices used, and other sources of radio disruption, as well as network faults and the way networks are utilized and maintained, can influence the service's quality and availability. svzto Mobile does not provide any assurances concerning the service and will not be liable for any issues, including, but not limited to, any failures in emergency (911) call services, that may arise due to any impact on the service's quality and availability to you, micro business owners, or end users. Furthermore, svztoMobile cannot guarantee compatibility between its equipment and the network or service, and it accepts no responsibility for any lack of interoperability between svzto Mobile's equipment and the network or service.


Services, Products, or Software provided by third parties may operate differently or may not function at all compared to our services. It is advisable to review the terms and conditions of such third-party products. We do not assume liability for the availability or reliability of 911 calls or text to 911 messages when using third-party products, and we cannot guarantee the accuracy of location information provided to the 911 Communications Center. We are unable to guarantee your location will be determined if you make a 911 call or send a text.

We disclaim any responsibility for issues pertaining to the download, installation, usage, transmission failure, interruption, or delay of Content & Apps or third-party content, services, advertisements, or websites accessible through your Device or the Services. It is your responsibility to uphold virus and other Internet security protections when accessing third-party Content & Apps or services.

We, along with any third parties involved in providing Services, will not be responsible for any harm, delays, disruptions, or failures that arise due to:

(a) The delivery or lack thereof of Services, which includes any defects or issues with Devices or network coverage;

(b) Incidents or health-related claims stemming from the use of our Services;

(c) Obstacles or failures in reaching emergency services via a Device;

(d) Disruptions, failures, or inaccuracies in location information services;

(e) Communications or data impeded by spam filters;

(f) Damage to your Device or any connected device or equipment, or the loss of data stored on your Device or elsewhere, as a result of using our Services or due to viruses, worms, or other harmful content;

(g) Circumstances outside our control, such as natural disasters, civil unrest, strikes, conflicts, acts of terrorism, or governmental actions or orders.

ARE THERE LIMITATIONS ON LIABILITY?

To the extent allowed by law, both parties— you and us— agree to limit any claims for damages or other monetary compensation against each other to direct, actual damages, regardless of the basis of the claim in liability theory. This agreement excludes any pursuit of indirect, special, consequential, treble, or punitive damages against one another. Specifically, this includes damages that may arise from unauthorized access to or alterations of your Account, Product, Service, or Device, or use of your Account, Service, Product, or Device by either you or others to authenticate, access, use, or modify third-party accounts, such as those related to finance, cryptocurrency, or social media platforms. This limitation also applies to any claims you might bring against other parties, insofar as we would need to indemnify that party for such claims. You recognize that we are not responsible for issues stemming from your actions, third-party actions, acts of nature, or unrelated criminal activities to Svzto Mobile. We are also not liable for missed or deleted voicemails or other messages, or for any loss or deletion of data (like photos) during service on your Device, nor for any failure or delay in connecting calls or texts to 911 or other emergency services. Moreover, we agree that any claims must be brought within two years from when the claim originated, as permitted by law.

Additionally, it's crucial to understand that we do not serve as publishers of content provided by third parties, including apps, services, or other materials, and we are not liable for the accuracy, quality, or reliability of any third-party opinions, advice, statements, services, or goods.

AM I REQUIRED TO INDEMNIFY Svzto MOBILE?

By accepting these terms, you agree to defend, indemnify, and hold harmless us, our directors, officers, and employees from any claims resulting from your use of the Services, Products, or Devices, and from any breach of this Agreement or violation of laws, regulations, or third-party rights by you, anyone linked to your account, or anyone you authorize to use the Services, Product, or Device.

ACCOUNT AND PAYMENT INFORMATION

WHAT IS A RATE PLAN?

Your "Rate Plan" encompasses your Service allocations, such as minutes, messages, or data, along with associated rates and terms. We reserve the right to offer access to new technologies, features, or services that you can opt to add for an extra fee. In the event of any conflict between the terms outlined in your Rate Plan and these Terms and Conditions, the terms specified in your Rate Plan take precedence.

HOW WILL I BE CHARGED FOR DATA USAGE?

Data service may be part of your Rate Plan or International Pass, or you may incur charges for data usage on a pay-per-use basis (referred to as a "Data Plan"). Details on how we calculate data usage will be outlined in your Rate Plan and/or Data Plan. To monitor your current usage, you can visit www.svzto.com. It's important to note that if you do not have a Data Plan, your device may be unable to access data services.

What's the process for allowing others to access my account?


An Authorized User is someone you appoint to have access and control over your account. They are granted the ability to:

  • Modify your account details;

  • Add or cancel services or features on your account;

  • Receive notices and disclosures intended for you;

  • Buy Devices compatible with our Service;

  • Generate Charges on your account.

The easiest way to appoint an Authorized User is through your online account portal. It's vital to keep your account validation information secure, such as the last four digits of your driver's license, credit card number, or your PIN/passcode, and to avoid sharing this information. An Authorized User will need to verify their identity to access account information. This means providing the last four digits of the primary account holder's driver's license, the account PIN/passcode, or the last four digits of the credit card on file when reaching out to us. Due to the sensitive nature of this information, safeguarding it is imperative. Providing accurate account validation details is interpreted as granting permission for account access. For accounts with enhanced security measures, verification of ID in person at a store may also be required.

What is the billing process for utilizing the services?

You are responsible for settling all Charges that we assess and bill you for, encompassing charges incurred during periods of service suspension due to non-payment, as well as Charges associated with all Devices and/or Products linked to your account, even during service suspension. It's imperative that you furnish us with accurate and comprehensive billing and tax information, promptly notifying us of any changes within 30 days. By default, you will receive electronic bills unless you specify a preference for paper bills. Should you opt for paper bills, a monthly fee of $5 will apply, which you can activate by adjusting your billing preferences on https://svztomobile.com/ or by reaching out to Customer Care.

Autopay is a convenient and free service offered by many companies, including banks, credit card issuers, utility providers, and other billers. Once you set up Autopay, it automatically deducts the amount due from your designated payment account on the scheduled payment date. This helps ensure that your bills are paid on time without requiring manual intervention each month.

Autopay offers several benefits:

  1. Convenience: With Autopay, you don't have to remember to make payments manually each month. Once it's set up, payments are made automatically according to the schedule you specify.

  2. Timely Payments: Autopay helps prevent late payments and potential fees associated with missing due dates, which can also help maintain a good credit score.

  3. Saves Time: You save time by not having to log in to different accounts or write checks each month to pay bills manually.

  4. Avoids Interruptions in Service: For essential services like utilities or subscription-based services, Autopay ensures continuous service by making payments on time.

  5. Flexibility: You can usually choose to pay the minimum amount due, the full balance, or a custom amount each month through Autopay.

It's important to regularly monitor your accounts to ensure that there are sufficient funds available to cover the payments and to review billing statements for accuracy. Additionally, if there are any changes to your payment account or billing details, it's essential to update your Autopay settings accordingly to avoid any disruptions in service or potential issues with payments.

Except where mandated by law, we won't provide advance notice or seek additional consent prior to charging your credit or debit card. It's your responsibility to promptly inform us of any changes to your payment card authorization. Payment via credit or debit card can be made exclusively at svzto.com. Alternatively, you can settle your charges through cash payments made in person at our local store. Please note that different payment channels or methods may incur additional service charges or fees. We reserve the right to impose return payment fees up to the maximum permissible by law. Furthermore, we retain the discretion to limit your payment options to cash or other secure forms of payment if warranted.

Off-Rate Plan Charges. You may have to pay extra for calls to some numbers (e.g. conference & chat lines, broadcast, calling card, international, 900 or 976 calls, etc.).

Usage.
Airtime usage is calculated from the moment the network begins processing a call, even before your phone rings or the call is answered, until the call ends after you hang up. For voice calls, any partial minute is rounded up to the next full minute. Data usage may be rounded at the end of each data session, at the close of your billing cycle, or when switching data plans, depending on your Rate Plan. You may incur charges for multiple calls or messages if certain features result in multiple inbound or outbound calls or messages, such as call forwarding, call waiting, voicemail, conference calling, and group messaging. Charges apply to text, instant, or picture messages, as well as emails, regardless of whether they are read or unread, sent or received, solicited or unsolicited. While spam filters are used to block unwanted messages, there is no guarantee that you will not receive spam or other unsolicited messages. Most usage and charges during a billing cycle will be included in your bill for that cycle. However, some usage and charges may be deferred to a subsequent billing cycle, potentially causing you to exceed your Rate Plan allotments in the future. Unused Rate Plan allotments expire at the end of your billing cycle. Additional charges may apply for certain features and services, and charges for Wi-Fi usage may vary; please refer to your Rate Plan for further details.

Taxes.

You are responsible for covering all taxes and fees imposed by governmental entities. These charges may be adjusted without prior notice. Taxes and fees are calculated based on the street address you've provided as your Place of Primary Use (PPU). If tax laws mandate a different address, we will use the best available information to determine the correct address.

If you haven't provided the correct PPU or if the address provided doesn't allow us to identify the applicable taxing jurisdiction(s), you may be assigned a default location for tax purposes. If you disagree with your PPU or the assigned location and the resulting taxes or fees on your bill, you must request a refund within 60 days of the bill date containing such taxes or fees.

Taxes and fees are subject to change without notice, regardless of any Rate Plan guarantee.

Surcharges.
You agree to cover all surcharges associated with your Rate Plan. These surcharges are not legally mandated but are charges imposed by svztoMobile to cover various costs incurred in providing services, including administrative fees and governmental-related assessments.

Examples of surcharges encompass Federal or State Universal Service fees, regulatory charges, environmental fees, and gross receipts taxes. The components and amounts of these surcharges may change without prior notice.

Surcharges will vary based on the type of service and Rate Plan you've chosen. They may alter without notice, notwithstanding any Rate Plan guarantee, subject to our 14-day notice policy if changes to your Service or Rate Plan will significantly affect you adversely.

You will be billed for these surcharges regardless of whether you directly benefit from the programs, activities, or services covered by the surcharge. Detailed information about surcharges can be found in the "Taxes, Fees & Surcharges," "svzto Mobile Fees and Charges," or "Other Charges" sections of your bill.

Other Fees.
We reserve the right to charge various fees for establishing, changing, or maintaining services. These fees may include activation fees, prepayment fees, reactivation fees, program fees, or other charges.

Additionally, certain transactions may also incur charges, such as convenience payments, changing phone numbers, handset upgrades, and more. We will inform you if any of these fees apply to the transaction you request.

If payments are not made on time, several consequences may follow:

You are accountable for all charges incurred until the conclusion of your service term, even if your service is suspended due to non-payment. In instances of delayed payment, we may impose a late fee, up to the maximum amount allowed by law. Additionally, returned payment fees may be applied at the highest permissible rate.

We retain the right to limit your payment methods to cash or other secure forms if deemed necessary for valid reasons. If your account is referred to a third-party collection agency, a collection fee assessed by svztoMobile will be due at the time of referral. This fee may be calculated as a percentage of the amount due, as allowed by applicable law.
